Model Contractual Clauses as per the Biodiversity Act of Bhutan 2022 and the Biodiversity Rules and Regulations 2023
As per the Biodiversity Rules and Regulations, the model contractual clauses include various agreements (scoping agreements, ABS agreements, material transfer agreements), certificates of compliance, sample transfer certificates, and Prior Informed Consent, etc.

The Biodiversity Act of Bhutan 2022
The Act will promote the wise use of natural resources as a development asset to contribute to the sustainable social and economic development of the country and the benefit of humankind.
The Act will promote the conservation and sustainable use of biological resources and covers the research and commercial utilization of Bhutanese genetic resources, their derivatives, and traditional knowledge.
The Act will provide the protection of plant varieties and the rights of breeders to encourage the development of new varieties. Further, the Act will protect the rights of farmers in respect of their contributions made in conserving, improving and making available the plant and animal genetic resources.

The ABS Policy of Bhutan 2015
Vision
The conservation and sustainable use of Bhutan’s biological heritage through securing the economic, social and spiritual well being of the Bhutanese people.
Scope
The National ABS Policy covers the research and commercial utilization of Bhutan’s genetic resources, their derivatives and associated traditional knowledge. It does not apply to access of
human genetic resources.This policy excludes biological resources when traded, shared,exchanged and used as commodities. If biological resources traded as commodities are later utilized as genetic resources for research and/or commercial purposes, such utilization shall be covered by the scope of this policy. This policy further excludes the use, sharing and exchange of traditional knowledge within and between local communities. If such knowledge is utilized beyond its traditional context for commercial and/or research purposes, such use shall be covered
by the scope of this policy.
